मध्य प्रदेश (MP) में 27% OBC Reservation के Legal Dispute में, जिन कर्मचारियों को पहले ही नौकरी मिल चुकी है, उनकी नौकरी बचाने के लिए आंध्र प्रदेश के एक पुराने फैसले की मदद ली गई है। हाई कोर्ट में ‘चेबरोलू लीला प्रसाद राव बनाम आंध्र प्रदेश राज्य’ नाम के फैसले का Reference दिया गया। इस मामले में सुप्रीम कोर्ट की Constitution Bench ने माना था कि अगर आरक्षण का नियम बाद में गलत या Unconstitutional भी मान लिया जाए, तो भी उसके तहत नौकरी पाने वाले कर्मचारियों की कोई गलती नहीं होती। इसलिए खास मौकों पर उनकी नौकरी रद्द करने के बजाय बचा ली गई थी और इस नियम को Humane Exception कहा गया।

मध्य प्रदेश में 27% OBC Reservation को लेकर शुरू हुआ यह कानूनी विवाद 2019 से 2026 के बीच विभिन्न चरणों से होकर गुजरा है:

  • 2019: कमलनाथ सरकार ने OBC Reservation को 14% से बढ़ाकर 27% करने का निर्णय लिया था। इसके बाद हाई कोर्ट ने कुल आरक्षण सीमा 63% हो जाने के आधार पर इस बढ़ोतरी पर Interim Stay लगा दी थी |
  • 2022: हाई कोर्ट ने मामले में स्पष्ट किया कि Final Decision आने तक 14% से अधिक ओबीसी आरक्षण का लाभ नहीं दिया जा सकता।
  • 2024-25: इस मामले से जुड़ी 70 से अधिक Petitions सुप्रीम कोर्ट पहुंचीं। सुनवाई के दौरान राज्य सरकार की ओर से तर्क दिया गया कि राज्य में पिछड़े वर्गों की कुल आबादी 50% से अधिक है |
  • 2026: सुप्रीम कोर्ट ने सभी Pending Petitions वापस मध्य प्रदेश हाई कोर्ट को लौटा दीं और मामले के जल्द से जल्द Resolution निर्देश दिया। इसके बाद Special Bench में Regular Hearing शुरू हुई।

हाई कोर्ट में पेश की गई 2023 की एक रिपोर्ट के अनुसार, मध्य प्रदेश की सरकारी नौकरियों में अकेले OBC वर्ग के लोगों की हिस्सेदारी 28.16% है। यह संख्या अभी मिल रहे 14% आरक्षण से दोगुनी से भी ज्यादा है और सरकार के नए 27% कोटे से भी 1.16% अधिक है।

अदालत में यह तर्क रखा गया कि जब सरकारी नौकरियों में इस वर्ग को पहले से ही पूरा मौका (पर्याप्त प्रतिनिधित्व) मिल रहा है, तो केवल ज्यादा आबादी को आधार बनाकर 50% की आरक्षण सीमा को तोड़ना कोई खास या असाधारण वजह नहीं मानी जा सकती।

इस मामले की सुनवाई के दौरान सुप्रीम कोर्ट के एक दर्जन से ज्यादा पुराने और ऐतिहासिक फैसलों का Reference दिया गया, जैसे कि इंदिरा साहनी मामला, मराठा आरक्षण, एम. नागराज, एम.आर. बालाजी और राम सिंह केस। इसके अलावा, इस जरूरी मामले में कुल 46 वकीलों ने  Arguments  की। इनमें याचिका दायर करने वालों की तरफ से 17 वकील और सरकार या दूसरे Defendants की तरफ से 29 वकील शामिल थे।

Defendants  में राज्य सरकार के 10, मामले में बीच में आने वाले Interventions के 14 और MPPSC के 5 वकील मौजूद थे। पटना हाई कोर्ट द्वारा 20 जून 2024 को बिहार के 65% आरक्षण वाले कानून को गैर-कानूनी Unconstitutional  ठहराए जाने वाले फैसले का उदाहरण भी अदालत में दिया गया।

  • BJP State President (Hemant Khandelwal): हेमंत खंडेलवाल ने आरोप लगाया कि 2019 में कमलनाथ सरकार ने बिना किसी मजबूत कानूनी आधार के जल्दबाजी में Ordinance पास किया था। बीजेपी 27% ओबीसी आरक्षण दिलाने के लिए पूरी तरह Committed  है और जरूरत पड़ने पर सभी पार्टियों की बैठक बुलाई जाएगी।
  • Congress State President (Jitu Patwari): जितू पटवारी ने कहा कि मौजूदा सरकार की तरफ से कोर्ट में कमजोर पैरवी करने की वजह से 27% ओबीसी आरक्षण को बड़ा झटका लगा है। उन्होंने मांग की कि सरकार तुरंत सुप्रीम कोर्ट में SLP – Special Leave Petition दायर करे, विधानसभा का Special Session बुलाए और Caste Census करवाए,कांग्रेस भी इस मामले में सुप्रीम कोर्ट जाएगी। 
  • OBC Mahasabha Threat: OBC महासभा की मुख्य समिति के सदस्य लोकेंद्र गुर्जर ने अदालत के फैसले पर दुख जताते हुए कहा कि इससे हजारों युवाओं का भविष्य अंधेरे में चला गया है। उनका संगठन इसके विरोध में बहुत जल्द पूरे प्रदेश में बड़ा आंदोलन शुरू करेगा।
